Sleep Deprived Worker Crashes Head-On into Motorist: Confidential Settlement
We represented the family of an oilfield safety supervisor who was killed
in a head on collision with a vehicle driven by an undocumented worker
who had been working for days without sleep. The worker was ordered by
his company to drive several hours while he was extremely fatigued, resulting
in him falling asleep at the wheel and killing Mr. Lee. As part of a significant
confidential monetary settlement in 2009, the at-fault company agreed
to conduct yearly safety seminars on fatigued workers and drivers, sponsor
safety awards in memory of Mr. Lee, create safety hotlines to report unsafe
work practices, and to clear all future employees with the Department
of Homeland Security prior to hiring.
