Wrongful Death Settlement Reached in Wyoming School Bus Highway Crossing Case

Apr 30, 2015

The Spence Firm, LLC has settled a wrongful death case on behalf of a family for their daughter's death. Their eleven-year-old daughter was struck and killed while exiting a school bus in Fremont County, Wyoming. She was directed by her school bus driver to cross a 65 m.p.h. highway at night. The bus driver expressly directed the child into oncoming traffic without sufficient time for her to safely cross the highway. She was struck and killed by an oncoming motorist.

Emily Rankin and Mel C. Orchard represented the victim's family in the wrongful death lawsuit brought in federal court in Wyoming. The case was against the school district for negligent bus routing that required children to cross highways at night and against the bus driver for his negligent instructions to the child. The case settled for a confidential amount prior to trial. Emily Rankin commented:

"No parent should worry about whether their child will make it home safely after riding a school bus. We hope that this lawsuit will educate those that transport our children to prevent a tragedy from happening again."
