ERISA: How to Handle a Subrogation and Reimbursement Agreement

Mar 26, 2024

The Spence Law Firm is committed to advancing knowledge among plaintiffs’ attorneys.  As part of that effort, we regularly teach continuing legal education (CLE) courses for other lawyers.  Attorney Michael Lutz recently taught a course for the Wyoming Trial Lawyers Association (WTLA) on how to handle ERISA liens.

Continuing legal education

The Employee Retirement Income Security Act of 1974 (ERISA) is a federal law that sets minimum standards for most voluntarily established retirement and health plans in private industry to provide protection for individuals in these plans.  ERISA liens can generate complex issues when pursuing or resolving personal injury claims. Michael Lutz provided a detailed analysis of how an ERISA lien may impact a settlement and how to approach dealing with those liens.  A video of the presentation can be made available for download upon request.
